Is It Legal To Consult With A Lawyer About A Small Claims Case?

I know you can’t get represented by a lawyer, but is it legal to see a lawyer about it on your own, and have the lawyer draft the documents and coach you on how to present your argument?
And if so, are any lawyers generally willing to do this type of thing? What would be a reasonable rate?

  4. You are correct, you cannot be represented by an attorney in small claims cases, but you can seek advice of an attorney. Just be prepared for the legal bill!
    I think some attorneys would not waste their time with something like this but there are definitely attorneys out there that will. Legal rates can vary from as low as $150/hour to $400/hour or more. All the attorneys I have worked for charge between $250 and $300/hour.

  6. This varies a little bit by state. Anyone has a right to the advice of an attorney.
    In Texas, it is fairly common for one or both parties to be represented by an attorney. In fact, if one of the parties is a corporation, an attorney must represent that party.
    Lawyers rates average $150 to $200 per hour or more for civil litigation. An attorney with considerable experience or a certified specialization may get much more than that.

  8. you can consult anyone you want to. theres nothing saying you can’t. if your going to court you need to get all the info you can to prove your case.
    you might not be able to take a lawyer to court with you but he certainly
    could give you advise.

  10. You can consult a lawyer about anything but you may find that it is not worth spending that much for a claim in a small claims court. Visit a lawyer and ask at their off ce about their costs. Asking the question costs nothing.

  12. Sure you can always consult a lawyer for any legal proceedings: Lawyer’s do appear in small claims when a corporation is either a plaintiff or defendant in a small claim complaint ,

  14. In each state small claims have limits on what you can collect.
    Go to one of those “First half hour free” attorneys.
    Yes it is legal to consult, just can’t take him/her with you.

  16. It’s not illegal at all. The advice may or may not help but you can certainly legally seek their counsel.
